The captain of a dive boat that caught fire off the coast of Southern California in 2019, killing all 33 of its passengers and a crew member, was sentenced on Thursday to four years in prison after a lengthy hearing that included emotional testimony from relatives of the victims. A federal jury in November found the captain, Jerry Nehl Boylan, guilty of misconduct or neglect of ship officer, a crime also known as “seaman’s manslaughter.”Mr. Boylan, 70, of Santa Barbara, Calif., was the captain of the Conception, a commercial scuba diving vessel, when a fire broke out in the early hours of Sept. 2, 2019, while the ship was anchored near Santa Cruz Island, according to prosecutors. Mr. Boylan and four other crew members were able to escape the fire, but the 33 passengers, who were sleeping below deck, died, prosecutors said. One crew member also was killed. Prosecutors said Mr. Boylan failed to try to save them.

CNN —A former dive boat captain could be sentenced to up to 10 years in prison Thursday on a negligence conviction known as “seaman’s manslaughter” after 34 people were killed in a fire that broke out on his boat in 2019. Jerry Nehl Boylan was found guilty in 2023 of one federal felony count of misconduct or neglect of ship officer last year. Thirty-three passengers and one crew member below deck died of smoke inhalation, police said. Thirty-four people were killed in the boat fire. In 2019, an attorney for the boat’s owner, Truth Aquatics, said that a crew member had checked the area where the fire was believed to have been concentrated before it ignited.

Trivett Jr., the prosecutor, discussing key details of the negotiations in open court for the first time. He added that “around the edges we have agreed to do things” and that “the positions that we took at the time are still available.”In mostly secret negotiations in 2022 and 2003, prosecutors offered to drop the death penalty from the case in exchange for detailed admissions by the accused architect, Khalid Shaikh Mohammed, and four other men who are charged as his accomplices in the hijackings that killed nearly 3,000 people. Since then, one of the five men has been ruled not mentally competent to stand trial. A judge on Monday declared a mistrial in the case of an Arizona rancher who was accused of murdering an unarmed migrant on his property after he crossed the U.S.-Mexico border last year, in a case that inflamed people on both sides of the national debate over immigration. The mistrial was declared after jurors were unable to reach a unanimous verdict during deliberations that began on Thursday. Days after Columbia University’s president testified before Congress, the atmosphere on campus remained fraught on Sunday, shaken by pro-Palestinian protests that have drawn the attention of the police and the concern of some Jewish students. Over the weekend, the student-led demonstrations on campus also attracted separate, more agitated protests by demonstrators who seemed to be unaffiliated with the university just outside Columbia’s gated campus in Upper Manhattan, which was closed to the public because of the protests. Some of those protests took a dark turn on Saturday evening, leading to the harassment of some Jewish students who were targeted with antisemitic vitriol. On Wednesday, Senate Democrats voted to declare as unconstitutional both articles of impeachment against Department of Homeland Security Secretary Alejandro Mayorkas — effectively ending the trial. It put a swift end to what had been a monthslong process by House Republicans, championed originally by Rep. Marjorie Taylor Greene of Georgia. Democrats agreed with Schumer's move, effectively rendering the articles moot and the trial over before House Republicans could present their case. Senate Republicans were also unsuccessful in their effort to pressure vulnerable Democrats to back their push for a longer trial. Greene forced her colleagues to vote on moving forward with Mayorkas' impeachment last November.
